We process your personal data in accordance with applicable data protection law, in particular the GDPR and national data protection provisions, for the following purposes:
We process personal data in connection with the (partial) letting of the Property to you. In letting the Property, we act economically for the account of the investment fund in which institutional investors hold an economic interest. Our processing activities serve the preparation, execution and performance of the lease agreements between you and us (we acting for the account of the investment fund). In doing so, we process the following personal data relating to you:
The data processing serves the preparation, execution, performance and termination of your lease agreement. As a rule, we do not collect the personal data from you; instead, it is transmitted to us by the property manager or the asset manager. However, data may also be collected directly from you or forwarded by the manager (property/facility manager) or other service providers engaged in connection with the tenancy, which process your personal data as sole controllers within the meaning of Art. 4(7) GDPR. Where this is necessary for the purposes stated above, we collect personal data from third parties (e.g. credit agencies, if rent is not paid or letters cannot be delivered) or from publicly accessible sources (e.g. commercial registers and residents’ registers).
Where necessary, we process your personal data in particular for notifications to building authorities, other reporting authorities and supervisory authorities and for other purposes required under supervisory law. This also includes in particular (where necessary) identification for anti-money laundering purposes in accordance with our internal policies and the statutory requirements. In addition, we may be obliged on the basis of a court decision (e.g. on the basis of a judicially enforced right to information) or an official order to disclose your relevant personal data, or it may be necessary to disclose personal data in the context of official or judicial measures for the purposes of taking evidence, criminal prosecution or the enforcement of civil-law claims (e.g. before a court or to a public prosecutor’s office). We are also obliged to have the Property valued regularly. In this context, only anonymised information is transmitted to the respective valuation firm.
Where necessary, we also collect creditworthiness data from our tenants in order to reduce the risk of losses from rent defaults. This constitutes our legitimate interest, which is why the processing of this data is permitted under Art. 6(1)(f) GDPR following a corresponding balancing against your interests that merit protection.
Furthermore, the beneficial owners of the fund or of the property companies have an interest in information relating to the letting of the property/properties (such as data from the lease agreement, consumption data and operating costs).
However, we provide this information exclusively in anonymised form. Finally, it may be necessary to pass on certain personal data to the respective valuation firm (property valuation by an external valuation firm).
Where necessary, the controller may process the biometric data contained in your identity documents (photograph), copies of which may have been transmitted to us.
This processing is necessary on the basis of our anti-money laundering obligations, as we are required to carry it out by law (Art. 6(1)(c), Art. 9(2)(g) GDPR in conjunction with the national anti-money laundering provisions).
Apart from the cases listed in section 2, the recipients of your data within our company are employees who process your data for the purposes stated above in accordance with a tiered authorisation concept.
In addition, service providers that support our activities may, where applicable, receive your personal data in the course of a service provider function, e.g. IT service providers. All our service providers process data exclusively within the European Union (EU) or the European Economic Area (EEA) and are contractually obliged to implement appropriate technical and organisational measures to ensure data protection and to maintain the confidentiality of personal data.
We pass on your personal data for the purposes stated in section 2, and only where there is a legal permission to do so, to affiliated companies that support our activities and also to public authorities. In addition, in the course of our processing we will pass on your personal data to third parties, in particular to IT service providers, external data centres, depositaries, auditors, tax advisers, lawyers and financing banks.
Your personal data is in principle transferred to a country outside the EU or the EEA (a so-called third country, e.g. the USA) only insofar as the transfer is required for the performance of the contracts concluded with you or is necessary for important reasons of public interest (for example, to fulfil tax reporting obligations).
We store your personal data for the duration of the tenancy. After the end of the tenancy and the fulfilment of all obligations arising from it, your personal data will be erased unless its further storage is necessary to comply with retention obligations under commercial, tax or supervisory law pursuant to European and national legislation as well as national regulations and circulars. We may also continue to store your data where this is necessary to preserve evidence within the framework of the statutory provisions on limitation periods.
The retention periods under commercial and tax law are up to ten years after the complete termination of the contractual relationship. In addition, the storage period is also determined by the statutory limitation periods, which, e.g. in Germany, are often three (3) years from the end of a calendar year but may in certain cases be up to thirty years. After the respective storage period has expired, your personal data will be erased.
There is no general obligation to provide us with personal data. However, the provision of personal data is in some cases required by law or necessary under the contract (see section 2 above). If you refuse to allow us to process data that we need to perform the contract or because of a legal requirement, it may not be possible to conclude the contract in the intended manner, or the contract may be terminated.
You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data concerning you which is carried out on the basis of Art. 6(1) sentence 1(f) GDPR. The objection is not subject to any formal requirements. You may also assert the following rights against us:
